Please read these Terms and Conditions (“Terms”) carefully before using Pokercat.

1. Introduction

1.1. These Terms govern the relationship between the operator of Pokercat (“Pokercat”, “we”, “us”, or “our”) and you, the individual using our services (“you” or “User”), arising from your use of the website located at https://poker-cat.com and the web application located at https://app.poker-cat.com (together, the “Service”).

1.2. By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, do not use the Service.

1.3. We may amend these Terms from time to time. Material changes will be announced on the Service or by email. Your continued use of the Service after a change takes effect constitutes acceptance of the amended Terms. If you do not agree with a change, stop using the Service and contact us regarding any unused credits.

2. Eligibility and Account

2.1. You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and that using the Service is lawful in your jurisdiction.

2.2. Registration and sign-in are handled through a third-party identity provider. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

2.3. Each User may hold and operate only one account. You may not sell, transfer, rent, or share your account or its credentials with any third party.

2.4. We may refuse registration, or suspend or terminate an account, in particular where the User has breached these Terms (including any previous breach under another account).

3. Description of the Service

3.1. The Service provides poker strategy information — including preflop and postflop strategy suggestions derived from game-theory-optimal (“GTO”) solver data and AI models — together with related features such as hand history storage and analysis.

3.2. The Service is an analysis and study tool. We do not operate, host, or facilitate gambling of any kind. No real-money wagering takes place on the Service.

3.3. Strategy outputs are informational in nature. They are generated by algorithms and statistical models, may be incomplete or incorrect, and are not a guarantee of any particular result, win rate, or profit. You remain solely responsible for every decision you make at a poker table.

3.4. Features of the Service may change over time. We may add, modify, or remove features at our discretion, and we are not obliged to provide updates.

4. Third-Party Platform Rules — Important Notice

4.1. Many poker sites and venues prohibit or restrict the use of real-time assistance tools, solvers, or similar software during play. It is solely your responsibility to know and comply with the rules of any poker platform or venue you play on, and with the laws applicable to you.

4.2. You acknowledge and accept all risks arising from your use of the Service in connection with any third-party poker platform, including but not limited to account suspension, account closure, or confiscation of funds by that platform. We accept no liability for any such consequence.

5. Credits and Payment

5.1. Certain features of the Service consume prepaid virtual credits (“Credits”). Credits are purchased in top-up packages at the prices displayed in the Service and are deducted per use at the rates displayed in the Service.

5.2. Payments are processed by third-party payment providers. We do not receive or store your payment card numbers, wallet private keys, or similar payment credentials.

5.3. Credits are a limited, non-transferable, revocable license to use paid features of the Service. Credits are not money, have no cash value, cannot be exchanged for cash, and cannot be transferred to another account.

5.4. Deductions occur only after the corresponding paid feature has been successfully executed. Per-use pricing may change from time to time; changes apply only to uses occurring after the change is published in the Service.

5.5. Refunds. Except where required by applicable law, top-ups are final and non-refundable once the payment has been confirmed, including payments made in crypto assets. If you believe you were charged in error (for example, a duplicate deduction), contact us at support@poker-cat.com and we will investigate and, where justified, re-credit your account.

5.6. If your account is terminated for a breach of these Terms, any remaining Credits are forfeited without compensation.

6. Acceptable Use

You agree that you will not:

  • use automated requests, scripts, bots, or scrapers against the Service, or assist any third party in doing so;
  • probe, disrupt, overload, or attempt to gain unauthorized access to the Service or its infrastructure;
  • resell, sublicense, monetize, or redistribute strategy data, ranges, charts, or other content obtained from the Service, whether directly or via a third-party application;
  • reverse engineer, decompile, or otherwise attempt to extract the source code, models, or solver data underlying the Service, except to the extent such restriction is prohibited by law;
  • upload or analyze hands or data belonging to third parties without authorization — the Service is intended for the analysis of hands you personally played;
  • use the Service in violation of any applicable law.

We may suspend or terminate access for any breach of this section.

7. Intellectual Property

7.1. The Service — including its software, design, solver data, strategy models, and documentation — is protected by copyright and other intellectual-property rights and remains our property or the property of our licensors.

7.2. You retain rights in the hand data you upload. You grant us a license to store and process that data as necessary to provide the Service (see the Privacy Policy for details).

8. Availability and Disclaimer

8.1. The Service is provided “AS IS” and “AS AVAILABLE”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

8.2. The Service may be subject to interruptions, maintenance windows, temporary limitations, or degradations in quality, including outages caused by hosting providers, network operators, third-party AI providers, or force majeure. We do not guarantee that stored data will be backed up or preserved indefinitely; you are encouraged to keep your own copies of anything important.

9. Limitation of Liability

9.1. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages — including lost profits, gambling losses, lost data, or losses arising from actions taken by third-party poker platforms — arising out of or relating to your use of the Service.

9.2. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the total amount you paid to us in the six (6) months preceding the event giving rise to the claim, and (b) USD 100.

9.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct or gross negligence.

10. Termination

10.1. You may stop using the Service and request account deletion at any time by contacting us at support@poker-cat.com.

10.2. We may suspend or terminate your access immediately if you breach these Terms or applicable law. Section 5.6 applies to Credits remaining on a terminated account.

10.3. Sections that by their nature should survive termination (including Sections 4, 7, 8, 9, and 12) survive termination.

11. Responsible Gaming

Poker involves financial risk. If you believe that you or someone you know has a gambling problem, please seek help — for example via the National Council on Problem Gambling (https://www.ncpgambling.org) or an equivalent organization in your country.

12. Governing Law and Disputes

12.1. If you have any concern or dispute regarding the Service, you agree to first attempt to resolve it informally by contacting us at support@poker-cat.com.

12.2. These Terms are governed by the laws of the jurisdiction in which the operator of the Service is established, excluding its conflict-of-law rules. If you are a consumer, you additionally benefit from any mandatory protections of the law of the country in which you reside.

13. Miscellaneous

13.1. Severability. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions remain in full force.

13.2. Waiver. A failure to enforce a right under these Terms is not a waiver of that right.

13.3. Assignment. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets; you may not assign your account or these Terms.

13.4. Language. These Terms are drawn up in English. If translations are provided, the English version prevails in case of conflict.
